In this article, we take a look at how trademark fees are determined. You would think it would be a simple, straightforward process, but it really is not.</p>
<p><strong>1. Paper vs. Online Filings</strong></p>
<p>The trademark filing process is, how shall I say this, one that takes a lot of patience. How long? It can take eight months just to get the first substantive correspondence from the examining attorney who reviews your application.</p>
<p>The problem is all the applications are handled through one office at the Patent &amp; Trademark Office and there simply aren’t enough examining attorneys to handle the work. In light of this, there has been a big move towards making things as efficient as possible. One step that affects filers is the move to encourage them to apply electronically instead of by snail mail and the corresponding effect on fees.</p>
<p>If you file an application by snail mail with the Patent &amp; Trademark Office, the fee is $375 per class. [We’ll get to classes in just a moment.] If you file the same application electronically through their website, the fee is $325 per class. This is a savings of $50 a class. Since most people file for numerous classes, it can make a big difference. If at all possible, get in the habit of filing electronically.</p>
<p><strong>2. Know Your Classes</strong></p>
<p>So, what is this filing fee per “class”? Well, a trademark filing is not an all encompassing legal right. There are different classes. One class might be for marks used on the internet while another might be for a mark used in fashion. A simple example shows why classes are necessary.</p>
<p>Amazon.com obviously is a very strong trademark. Anyone trying to use the Amazon name online runs the risk of being sued into oblivion for<img class="alignleft size-thumbnail wp-image-236" title="law2" src="http://www.trademarksafety.com/wp-content/uploads/2011/12/law2-90x90.jpg" alt="" width="90" height="90" /> trademark infringement. Ah, but what if I stared a business providing tours of the Amazon and named it “Amazon Trek”? Could Amazon sue me for infringing on their mark? No. My business area is travel and does not infringe on theirs. Put another way, we are in different classes.</p>
<p>As a general rule, you want to file for as many classes as possible when filing your application. You can find the list by going to uspto.gov, clicking “trademark basics” and then looking through the “Manuals…” section for the “ID Manual.” You can then enter the subject matter of your mark and see what classes apply.</p>
<p>To determine your filing fees, make sure you multiply the number of classes you are applying for versus the filing fee. For example, an electronically filed application claiming three classes would come with a fee of $975 [$325 x 3 classes]. The same application filed by snail mail would cost you $1,125 [$375 x 3 classes]. As you can see, filing electronically through the Patent &amp; Trademark Office can save you a good bit of money.</p>
<p>Trademark fees might seem a bit high. Well, they are. However, it is definitely worth it as the protection you get from filing is vital to any business. Attorneys fees in trademark infringement cases run in to the hundreds of thousands of dollars, so getting your mark in order just makes sense.</p>

<p>The purpose of a trademark is to protect the illegal or unauthorized use of a particular logo or name. Individuals that choose to register their trademark should realize that the legal aspects of these identifying marks can be organized into 10 basic elements of trademark law. Each of these laws is not arranged in any particular order but they are listed to show the basic legal aspects of registering and using a trademark within the United States.</p>
<p><strong>The first element of trademark law </strong>has to do with filling out an application and sending it in to the USPTO for registration. Trademarks do not have to be registered but an owner might lose some rights with protecting a product or service name or logo. So, it is strongly recommended that people register their trademark names and logos in order to enjoy the full benefits of the law.<img class="alignright size-thumbnail wp-image-141" title="LAW1" src="http://www.trademarksafety.com/wp-content/uploads/2011/11/LAW1-90x90.jpg" alt="" width="90" height="90" /></p>
<p>Companies, businesses and individuals can use the “ ™ ” or the “ ? ” symbols to inform the general public that they have ownership of a particular mark. These two particular marks can be used by anyone without registering with the United States Patent and Trademark Office (USPTO). The only way that anyone can use the symbol “ ® ” is for a product or service is when it has been filed with the trademark office. The “ ® ” symbol proves that a trademark was registered by the USPTO.</p>
<p><strong>The second thing that a person must understand about trademark law</strong> is to make sure that they have their logo or identifying mark presented within the application when they register. The USPTO must have a copy of the trademark logo on file with the Official Gazette and they will also print the mark on a registration certificate. Trademarks are usually registered within a year or up to a several years.</p>
<p><strong>The third element of trademark law</strong> has to do with determining if a mark will be categorized under “use in commerce” or “intent to use” and these designations is called the statement of use. The term “use in commerce” means that the trademark is currently used in business at the time of application filing and the term “intent to use” means that the trademark will be used in the future.</p>
<p><img class="alignleft size-thumbnail wp-image-142" title="LAW6" src="http://www.trademarksafety.com/wp-content/uploads/2011/11/LAW6-90x90.jpg" alt="" width="90" height="90" />Trademark attorneys typically do not file similar trademarks and they will usually give preference to a particular trademark that was received first. They will disregard any similar trademark logo or name that comes afterwards. A six month filing period is given for the statement of use.</p>
<p><strong>The fourth aspect of trademark law</strong> has to do with maintaining registration. Registrations must be maintained starting six years after the initial registration date and then every 10 years.</p>
<p><strong>The fifth element of trademark law</strong> is to understand that US registered trademarks are only good within the United States.</p>
<p><strong>A sixth point to trademark law</strong> has to do with filing a claim which cannot be done unless a licensed practicing attorney who is in good standing carries out the procedure.</p>
<p><strong>The seventh component of trademark law</strong> is recognizing that basic trademark information will be made available to the public. The eighth point of having a legal trademark has to do with interstate commerce and the validity of a trademark when it is used in another state other than the one where the mark is registered.<img class="alignright size-thumbnail wp-image-143" title="attorney3" src="http://www.trademarksafety.com/wp-content/uploads/2011/11/attorney31-90x90.jpg" alt="" width="90" height="90" /></p>
<p><strong>The ninth point of trademark law</strong> has to do with transferring ownership of a name or logo to another party.</p>

This is a complex legal matter that must be resolved in a court of law because there are too many variables involved with this type of situation to generalize how it should be treated.</p>

In 1946, Congress passed the Lanham act, defining federal protection and registration for trademarks.</p>
<p>The administrative authority was granted to the United States Patent and Trademark Office (USPTO), the agency in the Department of Commerce. This agency issues patents, and registers trademarks for products and intellectual property identification. State laws complement that of the federal system and continue to provide protection.</p>
<p>Trademark rights can be acquired by a person or business by using it on the label of a product sold to the general public or by filing an application for registration with the USPTO based on its actual use or bona fide intent to use. In the case of the bona fide intent to use, filing an application does not ensure registration.</p>
<p>Documentary evidence as to the use of the trademark in interstate commerce has to be established within a specified time. Infringement of trademarks can be curtailed only if they are registered. However, the bona fide intent to use application establishes priority.</p>
<p>It is not essential to register trademarks. However, there are some advantages of doing it. These advantages include issue of notice to the public about the claim of ownership by the person registering the trademark, a legal nationwide ownership of the trademark, and the exclusive right to use the mark.</p>
<p>The application for trademark registration in the USA can be filed by an individual. However, it is better to seek the help of an experienced attorney specialized in trademark registration. This is because a person inexperienced in trade mark prosecution matters may find it difficult to handle the process. The attorney may charge about $800 to $1,500 for the service. An application can be filed through the electronic medium using the Trademark Electronic Application System (TEAS) or on paper.</p>
<p><img class="alignleft size-medium wp-image-119" title="USPTO" src="http://www.trademarksafety.com/wp-content/uploads/2011/11/USPTO-150x150.jpg" alt="" width="150" height="150" />A prescribed fee has to be paid along with the application for registration of trade mark depending on how it is to be registered and for how many classes of goods or services it is being claimed. If the application is filed on paper, a fee of $375 per class has to be paid. If the application is filed through TEAS, then the fee payable is $325 per class. In the case of a TEAS Plus application that satisfies certain specific conditions, an amount of $275 per class is levied.</p>
<p>The same fee is payable when new classes are added to an existing application. A minimum amount, usually for one claim, will have to be paid to ensure that filing date is not denied and the application is returned. These charges are liable for change and hence it is important to check with the USPTO before filing the application.</p>
<p>Various options are available for payment of application fee. If the application is filed using TEAS, payment can be made by credit card or electronic funds transfer. It is also possible to transfer amount from the current USPTO deposit account that an individual or a business may have.</p>
<p>Payments can be made by checks or money orders if applications are filed on paper. An application that has been granted a filing date is not eligible for refund of fee. The time taken for processing an application for trademark registration in the USA may vary from a year to several years. It depends on the basis for filing and the legal issues that may come up during the examination of the application.</p>

<p>This means that when a business, company, manufacturer or individual creates a name they will automatically receive trademarked protection on their service or product. Even though this is the case it is best to register a trademark name with the USPTO to get the best benefit and protection from the law.</p>
<p>Understanding trademark law is important with getting the most out of using a trademarked name or logo. The first thing that a person must do after they create an identifying name or logo is to register it with the USPTO. They must make sure that they fill out application properly and to send in any required filing fees.</p>
<p>Applicants should make sure that they are filling out the statement of intent of the trademark name or logo since this identifies when the name or logo will be used for businesses. They are also required to send in a picture of the logo as well as a specimen.</p>
<p>A specimen is an actual product with the logo attached somewhere on the item. Service trademarks use advertisements or business related materials such as posters, fliers and business cards to identify a trademark name or logo. <p>Any organization or person filing a trademark name or logo should check the USTPO public records to identify if a trademark name or logo is already in use. Attorneys who examine trademark applications won’t allow any to be registered when they are almost the same as any other type of trademark.</p>
<p>Registration could also be denied if a person uses a name or logo for the same type of products or services as another trademark name on file.</p>
<p>Once a trademarked it’s published in the Official Gazette and a certificate is sent to the trademark owners. Once the registration process is completed trademark owners must file paperwork periodically in order to keep their logo or name current. The first filing will occur six years after the initial registration date and they will be required to file every ten years after this period.</p>
<p><img class="alignleft size-medium wp-image-89" title="law2" src="http://www.trademarksafety.com/wp-content/uploads/2011/11/law2-150x91.jpg" alt="" width="150" height="91" />Trademark information is made public and having a trademark also allows the use of a name or logo to be used in interstate commerce. <p>Trademark law also allows people to transfer ownership of their registered name or logo to another party. Trademarks that are registered to people who become deceased will need to be reviewed before the USPTO in order to determine who is going to be the owner of trademark.</p>
